Terms of Service

These Terms of Service ("Terms") govern your use of SideWRK (the "Service"), operated by SideWRK ("SideWRK", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Important: SideWRK provides documentation, estimating, invoicing, and record-keeping tools. It does not determine or guarantee compliance with the California Bureau of Automotive Repair ("BAR"), "Write It Right", or any other law or regulation, and nothing in the Service is legal advice. You are solely responsible for meeting the legal, licensing, tax, and regulatory requirements that apply to your work.

1. Who can use SideWRK

You must be at least 18 and able to form a binding contract. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity under your account.

2. The Service

SideWRK lets you manage customers and vehicles, build estimates and invoices, capture photos and documentation, send estimates for customer approval, record payments, and track your business. Features may change, improve, or be discontinued over time.

3. Subscriptions, billing & trials

SideWRK is a paid subscription service. Current plans are Standard ($29/month or $288/year) and SideWRK Pro ($100/month). Prices may change with notice.
Once paid billing is enabled, subscriptions are billed in advance through our payment processor (Stripe) and renew automatically until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period.
If a free trial is offered, you may be required to add a payment method, and you will be charged when the trial ends unless you cancel first.
Fees are exclusive of taxes, which you are responsible for. Except where required by law, payments are non-refundable.

4. Customer payments (optional)

If you enable card payments from your customers, those payments are processed by Stripe under Stripe's terms. SideWRK is not a party to the transaction between you and your customer and is not responsible for disputes, chargebacks, refunds, or taxes related to your sales.

5. Your data and your customers

You retain ownership of the business data you enter. You grant us a limited license to host and process it to provide the Service.
You are responsible for the accuracy of estimates, invoices, and records you create, and for any communications (texts/emails) you send to your customers through or alongside the Service.
You represent that you have the right to collect and use your customers' information and to contact them, and that your use of the Service complies with applicable law.

6. Acceptable use

Don't misuse the Service. You agree not to: use it for unlawful, fraudulent, or harmful purposes; send spam or unwanted messages; attempt to breach security or access other accounts' data; reverse engineer or disrupt the Service; or use it to violate anyone's rights.

7. Intellectual property

SideWRK, its software, branding, and content are owned by us and protected by law. These Terms don't grant you any rights to our marks or software except the right to use the Service as intended.

8. Third-party data (VIN & recalls)

Vehicle decode and recall information comes from third-party sources such as NHTSA and is provided "as is." We don't guarantee its accuracy, completeness, or timeliness; verify anything safety-related independently.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet any legal or regulatory requirement applicable to your business.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEWRK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold SideWRK harmless from claims, damages, and expenses arising out of your use of the Service, your business, your data, or your violation of these Terms or applicable law.

12. Termination

You can stop using the Service and cancel anytime. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; you may request an export or deletion of your data subject to our retention practices.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in California, unless applicable law requires otherwise.

14. Changes

We may update these Terms; we'll change the "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept them.
